ABOUT THESE TERMS

These are the terms of service (the “Terms of Service”) on which we supply products to you, when you order via our website www.manicureproject.com (our "Site"), or by communication with our client advisors (our "Advisors" via telephone (including instant messaging) or e-mail correspondence. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. Submitting an order constitutes your acceptance without restriction or reservation of these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We may amend these terms from time to time by posting revised terms on our Site. The terms applicable to your order will be those posted on the Site at the time of your order. If, after the date of their deletion from the Site, these Terms of Service nevertheless remain accessible to the public via other Internet sites or by any other means, they will however no longer be enforceable against Manicure Project.

1. WHO WE ARE AND HOW TO CONTACT US

We are Manicure Project and we are contactable via info@manicureproject.com. Alternative contact options are available such us via our "Contact an Advisor" contact form. If we have to contact you, we will do so in writing (including instant messaging) using the email address or postal address you provided to us in your order.

2. OUR PRODUCTS

2.1 Information about all Manicure Project items that may be sold on our Site or through Manicure Project Advisors, with product references, is outlined throughout the Site.

2.2 Our products are designed for professional use only and are not intended for use by children. Keep all products out of reach of children, as small components may pose a choking risk. Manicure Project is not liable for any misuse of the product, including use by or around children.

2.2.1 Our products are not toys and should not be handled by children.

2.2.2 Ensure proper storage to prevent unintended access by children.

2.3 When we refer to personalised items this refers in particular to items manufactured according to your specific requests or clearly personalised items (e.g., hot stamping or engraving products or their packaging). This also relates to standard items that are modified according to your requests. Regarding personalised items, we invite you to consult Article 9, set out below .

2.4 The images and/or illustrations displayed and our Site and/or otherwise communicated by Manicure Project are published for illustrative purposes only and have no contractual value. Although we have made every effort to ensure that the representations of the items on the Site are faithful to the items offered for sale, variations may occur and we cannot guarantee that the actual appearance of the items corresponds exactly to their appearance on the screen. We cannot be held responsible for errors or inaccuracies in the photographs and/or graphic representations of the items appearing on the Site, in particular in the event of variations in shade and/or grain that may occur due to technical limitations in the rendering of color and/or the grain of computer equipment.

3. PLACING ORDERS AND OUR CONTRACT

3.1 All orders are subject to availability. Orders can be placed via our Site or via communication with our Advisors.

3.2 We only deliver in the United Kingdom (UK) and certain regions outside of the UK which include but are not limited to Australia, New Zealand and most countries in Europe. Availability of delivery to international destinations may be made available or unavailable at any time.

3.3 You must be at least eighteen years old to place an order. By placing an order, you affirm that you are at least eighteen years old and are fully able to enter into and be legally bound  by such transactions.

3.4 We only sell our retail products directly to the consumer. Your order on our Site or through communication with our Advisors must not be made for or on behalf of any business activity and must be placed strictly for your personal use. 3.5 We will acknowledge receipt of your order without delay by sending you a confirmation email, but this confirmation email does not constitute our acceptance of your order. Your order will only be accepted by us when it is dispatched, and you receive a dispatch email from us (see 3.6 and 3.7).

3.6 Our acceptance of your order will take place when we email you and tell you we have accepted and/or dispatched your order, at which point a contract will come into existence between you and us.

3.7 If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product. This may be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product, because we are unable to meet a delivery deadline you have specified or if the order is not in accordance with these Terms of Service.

3.8 We will assign an order number to your order and tell you what it is when we acknowledge receipt of your order. lt will help us if you can tell us the order number whenever you contact us about your order.

4. PRICE AND PAYMENT

4.1 The price of the product in pounds sterling (£) will be the price indicated on the order pages when you place your order (or communicated to you in writing). This price is not including VAT or any additional charges (e.g., for delivery). Manicure Project is not VAT registered and so we do not charge VAT on any orders. We take all reasonable care to ensure that the price of the product advised to you is correct. However please see 4.2 for what happens if we discover an error in the price of the product you order. Manicure Project reserves the right to modify the prices of the items at any time and without notice, but the price that applied at the time of your order is the one that will apply.

4.2 lt is always possible that, despite taking all reasonable care, some of the products we sell may be incorrectly priced. If the product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order at the correct price. If we accept and process your order where a pricing error is material, obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.

4.3 We accept payment by credit or debit card, by Apple Pay (available only on iOS), or other payment methods as they become available from time to time by notice on our Site. Payment must be made in pounds sterling (£). You warrant that you are the holder of the card and that the name appearing on the card to be debited is yours. To pay, you shall communicate in a secure digital environment, the number and expiry date appearing on the front of your bank card as well as the numbers of the visual cryptogram appearing on the back (or front) of your bank card.

4.4 You must pay before goods are dispatched to you. You will be debited once you have placed your order and it has been accepted by us. We will inform you by email once the products have been dispatched. Title to the product passes to you upon the latest of (i) full payment of the order and (ii) delivery of the product to you.

4.5 If your payment cannot be processed for any reason (including, for example, stopped payment, refusal by the issuer of the card), your order will be cancelled and the contract with you ended immediately. We will inform you of this in writing.

4.6 Payments through our Site are managed online with the relevant banking organisations through facilities offered by Shopify which enables us to accept and manage payments, mitigate fraud, and secure payment data. Your persona! information including your name, email address, delivery details, telephone number, details of the order placed and credit card or other payment details will be disclosed and used by Shopify exclusively for the purposes of providing fraud screening services to us and to its own customers, as further detailed in our Privacy Policy. You warrant to us that you have been, are and will remain in compliance with applicable national and international laws and regulations or any other breach of integrity. If an order placed by you is considered to be fraudulent or otherwise made in breach of this Terms of Service, the order will be cancelled immediately, and in the event that any sums have already been debited to you, they will be refunded within 14 business days after such notification.

5. PROVIDING THE PRODUCTS

5.1 The costs (if any) of delivery will be as displayed to you on our website.

5.2 Delivery times vary and are outlined in our Shipping Policy.

5.3 We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event.

5.4 If, at the time of delivery, the packaging is damaged, please open the package in the presence of the carrier in order to verify the condition of the products. ln the case of delivery, where there is damage to the products, you should note the details on the delivery note and contact us. If we deliver products to you and products are damaged by our carrier we will replace the products free of charge (including costs of re-delivery) but only where:

5.4.1 You tell us in writing within 48 hours of the actual delivery date.

5.4.2 You produce to us any receipt or other documents relating to the products and (in the case of damaged items) the original packaging for the products complete with all related protective covers and boxes.

5.5 The products will be your responsibility from the time you or a person indicated by you acquires the physical possession of the goods.

5.6 You own the products on the later of the following:

5.6.1 Once we have received payment in full;

5.6.2 Once the products have been delivered to you.

6. YOUR RIGHTS TO END OUR CONTRACT

You have a legal right to change your mind within fourteen days from receipt of your order. Please view our Return and Refund Policy for details.

7. PROMOTIONS AND SPECIAL OFFERS

Promotions and special offers are available at our sole discretion and may be subject to specific terms and conditions. Discounts cannot be combined unless explicitly stated, and they do not apply to shipping fees or other non-product charges. We reserve the right to modify or withdraw any discount at any time without prior notice.

8. LIMMITED EDITION ITEMS

Limited edition items are available in restricted quantities and may not be restocked once sold out. Due to their exclusivity, these items are non-refundable and not eligible for discounts unless explicitly stated. We reserve the right to limit the purchase quantity per customer to ensure fair access to these items.

9. PERSONALISED ITEMS

Manicure Project offers customisation for certain items. These include items manufactured according to your specific requests or clearly personalised items (e.g., hot stamping or engraving products of their packaging). This also relates to standard items that are modified according to your requests. All provisions of the Terms of Service above, not modified by these Special Conditions, remain applicable.

9.1 Special Terms

9.1.1 When using the personalisation service on the Site, the customer's creative choices are their responsibility and are only stored for the duration of their session (if the customer interrupts their session, they will be prompted to resume their creative choices from the beginning when they log in again). The customer is also fully responsible for ensuring that the details of the personalisation are correct, comply with their needs and all applicable laws and regulations. The customer also ensures that the content of the personalisation does not infringe any third-party rights and does not contain any personal data of another person.

Once the order has been validated by the customer on the Site, the customer will be debited for the amount of their order. The customer will then receive an email informing them of the shipment of the items.

9.1.2 Given their clearly personalised and/or custom-made nature, the items referred to in these Special Terms cannot be returned or refunded. Consequently, Article 6 of the Terms of Service above does not apply to these personalised and/or custom-made items. Notwithstanding the above, the customer continues to benefit from our Warranty.

10. LEGAL NOTICE

This website (hereinafter the "Site") is published by Manicure Project, an independent business operating in the United Kingdom.

10.1 The Site is hosted by Shopify.

10.2 Access to the Site and the use of its content are subject to the conditions set forth below. By accessing the Site, visitors agree to abide by these terms. If a visitor does not accept these terms, they should discontinue use of the Site.

10.3 This Site and all materials, text, content, software, graphics, photographs, illustrations, artwork, formats, files, and links contained in it (collectively, "Content") are protected by copyright, trademarks, and other intellectual property rights owned by or licensed to Manicure Project.

Visitors may view the Content for private, personal use only. The Content may not be copied, reproduced, modified, distributed, or used for commercial purposes without prior written consent from Manicure Project.

10.4 Manicure Project products are sold exclusively through our official Site and our official North America distributor Gloss Nail Co. Any purchase made outside of these channels is at the buyer’s own risk, particularly regarding the authenticity of such items.

10.5 We take steps to ensure the information on the Site is accurate and up to date; however, we do not guarantee the completeness, accuracy, or timeliness of any material on the Site. Content is subject to change without notice.

10.6 Access to the Site may be interrupted for maintenance, security, or technical reasons. We are not liable for any temporary unavailability of the Site or any resulting loss or inconvenience.

10.7 Visitors agree not to misuse the Website in any way, including but not limited to attempting unauthorized access, transmitting harmful code, or using the Website for fraudulent or unlawful purposes.

10.8 We make every effort to ensure that product descriptions, images, and specifications on the Site are accurate. However, variations may occur, and we reserve the right to modify product details without prior notice.

10.9 For details on how we collect, use, and protect your personal data, please refer to our Privacy Policy.

10.10 To the fullest extent permitted by law, Manicure Project shall not be liable for any indirect, incidental, special, or consequential damages resulting from access to or use of the Site. This does not affect our liability for fraud, personal injury, or any other liability that cannot be excluded under applicable law.

10.11 Hyperlinks to this Site from third-party sources require prior written consent from Manicure Project. We are not responsible for the content of any external websites linked from our Website.

10.12 These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10.13 These terms may be updated at any time. By continuing to use the Site after changes are posted, visitors accept the revised terms. It is the visitor’s responsibility to review them periodically.
